Software firm sues Justice's Southern Coal for failure to abide by settlement

Softwarefirm FusionSoft LLC filed a lawsuit April 27 against Appalachian coal operatorJim Justice's Southern Coal Corp.over an alleged failure to pay a settlement in a breach-of-contract dispute.

The complaintfiled in the U.S. District Court for the Southern District of Indiana demandspayment of $280,000 plus pre-judgment interest and attorney's fees.

Indiana-basedFusionSoft filed the complaintin October 2013, alleging Southern Coal contracted with the company forComTrac, a commodities software management system, and for hosting services inNovember 2012, but later tried to get out of the agreement. Fusion was seeking$330,000 in damages. The parties settledthe dispute in 2014.
