Bennett Hatfield, the former CEO and president of Patriot Coal Corp., was found dead in May 2016 in a Mingo County cemetery where he was apparently visiting his wife's grave. Arriaga and Fitzpatrick were indicted in January on charges of first-degree murder, conspiracy to commit robbery, conspiracy to commit murder and robbery.
At pretrial hearings Aug. 10, the judge ruled that a jury can consider phone calls Fitzpatrick made to his family and friends while in jail and that she would consider making available transcripts of several statements Arriaga allegedly made to police and reporters.
Hatfield had also held positions at Massey Energy, Arch Coal Inc. and Foresight Energy LP.
