Alere seeking to reinstate Medicare privileges of diabetes unit

Alere Inc. is asking the Centers for Medicare & Medicaid Services to reconsider its decision to revoke the Medicare billing privileges of its diabetes diagnostic business, Arriva Medical.

The company filed an appeal with the CMS administrative law judge to reinstate Arriva's billing status for diabetes testing more than a month after it was revoked.

Meanwhile, the company filed a complaint with the U.S. District Court for the District of Columbia to prevent the CMS from terminating Arriva's billing status pending the outcome of the appeal.

The CMS revoked Arriva's Medicare supplier billing number Nov. 4 and barred the company from re-enrolling in the program for a period of three years after a string it filed claims for 211 dead patients.
