The Pennsylvania Commonwealth Court declared a publicutility corporation, with the right to exercise . The decision, whichaffirms the lower court's earlierruling, gives the partnership's Mariner East 2 project more room to move forward.

The court alsodetermined, amid opposition,that the Sunoco LogisticsPartners LP unit'sMariner East 2 provides a public service to the citizens of the state,according to a July 14 news release.

"[W]e have always worked with landowners to reachmutually acceptable agreements, and pursued legal proceedings only in thoseinstances where an agreement could not be reached," Sunoco said in astatement.
