The investigationrelates to allegations that certain statements issued by BHP Billiton Ltd. werefalse and misleading, and that the company failed to disclose material informationregarding its financial performance.
Lundin willdetermine whether the company violated Sections 10(b) and 20(a) of the SecuritiesExchange Act of 1934.
Specifically,the investigation will focus on a Feb. 23 report that Brazilian police are pursuinga court order to arrest certain SamarcoMineração SA executives.
To date, noclass has been certified in the above action.
On March 2,BHP Billiton Group, along with ValeSA and their joint venture Samarco, entered into a 15-year agreement with Brazilian authoritiesregarding the rehabilitation of the Samarcodam disaster.
