Vivint Solar Inc.said in a Form 10-Q filing that it will participate in SunEdison Inc.'s Chapter 11 bankruptcy case in order to maximize the recovery from itsclaims against the Missouri-based company.
Vivint Solar had filed a lawsuitin the Delaware Chancery Court alleging that SunEdison deliberately breached itscommitments under the mergeragreement. The Utah-based company is seeking damages based on the value of the original$2.2 billion deal, rather than the lower renegotiated price.
In the May 10 filing, Vivint Solar said it is seeking "declaratoryjudgment, award damages, costs and reasonable attorney's fees and such further reliefthat the court finds equitable, appropriate and just."
