Intuitive Surgical to settle surgical system class action for $42.5M

Intuitive Surgical Inc. agreed to settle a class-action lawsuit over its robotic surgical system for $42.5 million.

The lawsuits, filed in the U.S. District Court for the Northern District of California, involves the company's da Vinci surgical system, a robotic platform used for minimally invasive surgery.

Plaintiffs accused Intuitive Surgical of concealing da Vinci's internally known defects, and not reporting all malfunction complaints to the U.S. Food and Drug Administration. The regulator eventually started a probe of Intuitive Surgical in 2013.

The settlement remains subject to certain conditions, including court approval.

Sunnyvale, Calif.-based Intuitive Surgical makes and sells surgical systems and related instruments and accessories.
