Florida Power & Light Co. is asking the state supreme court to review an appeals court decision rejecting the approval of transmission lines for its planned new nuclear reactors at the Turkey Point facility.

The NextEra Energy Inc. subsidiary filed a notice that it will ask the Florida Supreme Court to take up an April decision by the state 3rd District Court of Appeal. The notice was posted to the 3rd District Court of Appeal's docket on Dec. 22. (Case No. 3D14-1467)

The April decision by the 3rd District Court of Appeal sided with the City of Miami, Miami-Dade County and other municipalities, ruling that the State Siting Board overlooked local ordinances when it approved the transmission line plans for the planned units 6 and 7 at Turkey Point. Among the errors mentioned by the 3rd District Court of Appeal was the Siting Board thinking it did not have authority to require FPL to install lines underground at the utility's expense, and misinterpreting certain county regulations. The City of Miami had also objected to FPL's plans to erect 105-foot-high poles in urban areas.

A request by FPL for a rehearing was denied by the 3rd District Court of Appeal on Nov. 22, according to the docket.
