German court rules in favor of ResMed in Fisher & Paykel patent case

ResMed Inc. said the Munich District Court ruled in its favor in a patent infringement case against Fisher & Paykel Healthcare Corp. Ltd.

The German court found that ResMed's AirSense 10, AirCurve 10, Lumis and its humidifiers do not infringe Fisher & Paykel's patent for a German utility model.

Previously, the same German court said Fisher & Paykel's Simplus, Eson and Eson 2 masks infringe on ResMed's patents. However, it suspended two patent proceedings involving the two companies pending the result of invalidation proceedings.

ResMed intends to continue the patent challenge against Fisher & Paykel's German utility model before the German Patent and Trademark Office.

The company said the German ruling has no effect on their patent infringement cases against Fisher & Paykel in other jurisdictions.
