A member of Ames, Iowa-based Greater Iowa CU has sued the credit union, alleging an unlawful attempt at debt collection on a defaulted auto loan, the West Virginia Record reported Aug. 1.
The complaint, filed by Norman Jeffries on behalf of himself and other similarly situated individuals at the Ohio Circuit Court, also name debt collection firm CU Recovery Inc. as a defendant.
The suit claims that CU Recovery, representing Greater Iowa CU, sent a demand letter for an auto loan the plaintiff defaulted on in 2010, which saw the car repossessed and the loan charged off. The letter, which the plaintiff received in May 2016, did not disclose that the debt was time-barred.
The suit is seeking actual damages and/or restitution of payments, statutory damages, costs of litigation, attorneys' fees and other relief.
