WTO rules in favor of Argentina in EU biodiesel import duties dispute

London — The World Trade Organization ruled late Tuesday in favor of Argentina in a dispute over import duties imposed on Argentinian biodiesel by the European Union in November 2013.

The Argentinian complaint was formally raised in December 2013, following the introduction of anti-dumping duties ranging from Eur216.64/mt to Eur245.67/mt ($245.39-$278.27/mt).

Market participants were divided regarding the impact of any lifting of duties by the EU, as blender demand in 2016 is expected to be focused on UCOME and other double-counted biodiesel, rather than single-counted material of the type produced in Argentina.

The EU has an option to appeal against the panel report, which said Argentinian production costs were not properly calculated as part of the EU anti-dumping ruling.



The EU acted "inconsistently" with standard anti-dumping agreements, said the WTO.

The WTO would have to respond to any EU appeal within 60 days.

A complaint lodged with the WTO by Indonesia against anti-dumping duties on its biodiesel exports to the EU is still ongoing.
