Democrats file court brief backing English as CFPB acting director

Democratic lawmakers filed an amicus brief arguing that newly appointed deputy director Leandra English should serve as acting director of the Consumer Financial Protection Bureau until the Senate confirms the new director.

The brief was filed on Nov. 27 by U.S. House Committee on Financial Services ranking member Maxine Waters, D-Calif., and 25 current and former Democrats with the D.C. Circuit Court of Appeals.

Hours after outgoing director Richard Cordray appointed English as deputy director on Nov. 24, Trump appointed Mick Mulvaney, director of the Office of Management and Budget, as acting director of the CFPB, causing confusion and controversy on who should lead the consumer watchdog. On Nov. 26, English filed a lawsuit seeking to block Mulvaney's appointment.

The Democratic lawmakers criticized Mulvaney as a designee reflecting President Donald Trump's policy preferences. "President Trump is entitled to choose who the next Director of the Bureau will be," but until he nominates someone and until that person gets Senate confirmation, English should run the bureau, the lawmakers said.
