Medical device manufacturer Calmare Therapeutics Inc. said the U.S. Court of Appeals for the 2nd Circuit denied GEOMC Co. Ltd.'s application to reconsider a March 2019 judgment.
The appeals court had overturned a 2017 judgment handed by the U.S. District Court for the District of Connecticut which awarded $10.4 million in damages to GEOMC. The appeals court then remanded the case to the district court for further proceedings.
South Korea's GEOMC had sued Calmare in 2014 in the district court for allegedly failing to comply with the terms of a security agreement.
Under the agreement, GEOMC was expected to manufacture Fairfield, Conn.-based Calmare's pain therapy device in exchange for a security interest in the devices.
