Judge allows Yahoo data breach suit to proceed

U.S. District Judge Lucy Koh in San Jose, Calif., allowed a lawsuit filed against Yahoo! Inc. over the security breach of customer data to proceed.

While dismissing some claims, Koh declined to dismiss claims such as negligence, breach of contract, deceit by concealment, and declaratory relief claim, according to a March 9 filing in the U.S. District Court, Northern District of California, San Jose division.

In November 2017, former Yahoo CEO Marissa Mayer apologized to users for data breaches at the internet company while testifying before the Senate Commerce Committee. A 2013 security breach at Yahoo affected all 3 billion user accounts the company had at that time, the company revealed in October 2017. Yahoo has now been renamed Altaba Inc. after Verizon Communications Inc. acquired its operating business.
