Mexico's Federal Court rules in favor of Consolidated Zinc in land use dispute

The Federal Court of Mexico ruled in favor of Consolidated Zinc Ltd. unit Minera Latin American Zinc SAPI de CV and cancelled a previous decision by the appeals court of Chihuahua, which favored a local rancher, over a land use agreement dispute.

Minera Latin American Zinc holds the company's 90% interest in the Plomosas zinc-lead-silver mine in Mexico's Chihuahua state.

According the company's Aug. 28 release, the federal court referred the case back to the appeals court, saying the latter should consider all evidence submitted, including the land use agreement and its terms and conditions.

Consolidated Zinc said its unit as well as previous owner Retec Guaru SA de CV complied with agreement terms, including the payment of all rental charges, and no default notice was issued by the local rancher.

The unit has also successfully defended the local rancher's claims on two previous occasions in the civil courts of Chihuahua, the company noted.
