Japanese court dismisses Shionogi patent infringement lawsuit

A Japanese court upheld a patent ruling against Shionogi & Co. Ltd. covering one of its HIV medicines.

The Japanese company had filed a lawsuit against Merck & Co. Inc. in August 2015, saying that the medicine Isentress infringed on one of its patents. However, Merck challenged the validity of the patent with the board of the Japanese Patent Office which concluded that the patent was invalid.

Shionogi appealed the decision but the Intellectual Property High Court of Japan has now dismissed the lawsuit.

Shionogi, which also holds a stake in HIV drugmaker ViiV Healthcare Ltd., added that the disputed patent was held singly by the company and is not related to ViiV Healthcare's medicine Tivicay.
