Selima Optique Inc. on Dec. 1 voluntarily dismissed a lawsuit it filed against French luxury goods group Kering SA that claimed Kering was employing a "bait-and-switch" scheme and deliberately mislabeling its eyewear products, The Fashion Law reported Dec. 5, citing a statement from Kering.
The eyewear retailer in June filed a lawsuit against the luxury conglomerate claiming the company was misleading customers by mislabeling luxury eyewear products to say they were made in Italy when they were made in China. Kering, whose brands include Gucci and Balenciaga, denied the claims and said its eyewear products are labeled in compliance with applicable laws.
According to The Fashion Law, a website focused on news related to fashion law and business, Selima dropped the complaint "with prejudice and without any payment from the Kering group." The legal term "dismissal with prejudice" bars a plaintiff from filing a lawsuit on the same issue at a later date, the report said.
