Plaintiff dismisses lawsuit against MB Financial

The plaintiff in the lawsuit that sought injunctive relief against the consummation of MB Financial Inc.'s merger with Cincinnati-based Fifth Third Bancorp agreed to withdraw and dismiss the claims.

The complaint alleged that MB Financial failed to disclose material information about the deal.

In response, MB Financial made additional disclosures related to the merger. The company said the additional disclosures were made solely to eliminate the burden of further litigation and to avoid delays to the closing of the merger.

In light of the additional disclosures, plaintiff agreed to dismiss the action. The dismissal allows the plaintiff to reserve the right to seek an award of attorneys fees from the court.
