FERC swats down Sierra Club request to stop Nexus pipeline

The Federal Energy Regulatory Commission denied a Sierra Club request for a rehearing and stay of Nexus Gas Transmission LLC's 1.5-Bcf/d pipeline project, a joint venture of DTE Energy Co. and Enbridge Inc.

FERC concluded the environmental group and other project opponents had not proved they would suffer "irreparable harm" from the pipeline. The opponents had asked the commission to reconsider the pipeline's certificate order and for a new study of the need for the project.

"The commission determined that [the project] ... is an environmentally acceptable action," the Jan. 10 filing said.

The Sierra Club had also filed a motion in November 2017 with the U.S. Appeals Court for the D.C. Circuit to halt ongoing construction work while the court reviews the FERC authorizations, but the group dropped that case later in the month.

The commission issued a certificate order on Aug. 25, 2017, for the project, after commission staff delivered a positive environmental impact statement.

The over $2 billion pipeline will include 256.6 miles of 36-inch diameter greenfield pipeline, four new compressor stations and an interconnect with Tennessee Gas Pipeline Co. The project would deliver Marcellus and Utica shale supplies to Ohio, Michigan and Ontario. (FERC dockets CP16-22, CP16-23, CP16-24, CP16-102)
